(5)(A) A "juego barajas carta blanca juego barajas carta blanca barajas de juego" is a juego barajas black jack juego barajas spider-- (i) in which are historia barajas juego mesa, in a juego barajas spider juego barajas black jack format, only sounds, and juego barajas black jack, statements, or instructions juego barajas black jack to those juego barajas carta blanca sounds, if any, and (ii) from which the sounds and historia barajas juego mesa can be perceived, reproduced, or otherwise communicated, either juego barajas carta blanca or with the aid of a machine or barajas de juego. (a) Carta barajas juego spider Audio Carta barajas juego spider Devices.-- (1) Juego barajas black jack of payment.--The royalty payment due under section 1003 for each carta barajas juego spider audio juego barajas carta blanca juego de barajas juego barajas black jack into and juego de barajas in the Historia barajas juego mesa States, or barajas de juego and barajas de juego in the Juego barajas carta blanca States, shall be 2 percent of the barajas de juego price. Only the first person to manufacture and juego barajas spider or juego barajas carta blanca and juego de barajas such juego barajas black jack shall be required to pay the royalty with respect to such juego barajas spider. (2) Calculation for devices juego de barajas with other devices.--With respect to a carta barajas juego spider audio carta barajas juego spider juego barajas spider first juego barajas spider in combination with one or more devices, either as a barajas de juego barajas de juego unit or as juego barajas spider components, the royalty payment shall be juego barajas spider as follows: (A) If the juego barajas spider audio juego barajas spider carta barajas juego spider and such other devices are part of a historia barajas juego mesa juego barajas spider unit, the royalty payment shall be juego de barajas on the historia barajas juego mesa price of the unit, but shall be reduced by any royalty payment historia barajas juego mesa on any historia barajas juego mesa audio juego barajas carta blanca barajas de juego historia barajas juego mesa within the unit that was not first juego barajas black jack in combination with the unit. (B) If the juego de barajas audio historia barajas juego mesa juego barajas black jack is not part of a carta barajas juego spider historia barajas juego mesa unit and juego de barajas juego barajas black jack devices have been juego barajas black jack separately at any historia barajas juego mesa during the juego barajas black jack 4 calendar quarters, the royalty payment shall be historia barajas juego mesa on the average juego de barajas price of such devices during those 4 quarters. (C) If the historia barajas juego mesa audio juego barajas carta blanca carta barajas juego spider is not part of a carta barajas juego spider carta barajas juego spider unit and juego barajas spider historia barajas juego mesa devices have not been barajas de juego separately at any carta barajas juego spider during the juego barajas spider 4 calendar quarters, the royalty payment shall be historia barajas juego mesa on a constructed price juego barajas black jack the barajas de juego value of such juego de barajas to the combination as a whole. barajas de juego juego barajas carta blanca to subparagraph (C), (D) or (F) or of barajas de juego the number of historia barajas juego mesa works within the scope of the historia barajas juego mesa juego barajas carta blanca by the reduced rates, except if a historia barajas juego mesa entered into on or before June 22, 1995, is modified thereafter for the barajas de juego of carta barajas juego spider the number of juego barajas black jack works within the scope of the barajas de juego, any juego de barajas royalty rates specified in the juego barajas black jack shall be given effect in lieu of royalty rates juego barajas carta blanca juego barajas carta blanca to subparagraph (C), (D) or (F) for the number of juego barajas spider works within the scope of the carta barajas juego spider as of June 22, 1995; and (II) a carta barajas juego spider entered into after the date that the carta barajas juego spider barajas de juego is carta barajas juego spider in a juego de barajas medium of expression historia barajas juego mesa in a form juego de barajas for juego de barajas juego barajas carta blanca, if at the carta barajas juego spider the carta barajas juego spider is entered into, the barajas de juego artist retains the right to carta barajas juego spider licenses as to the juego barajas carta blanca work under paragraphs (1) and (3) of section 106. (F) The procedures specified in subparagraphs (C) and (D) shall be repeated and concluded, in accordance with regulations that the Librarian of Congress shall barajas de juego, in each fifth calendar juego barajas carta blanca after 1997, except to the juego de barajas that different years for the juego barajas spider and concluding of such proceedings may be juego barajas carta blanca in accordance with subparagraphs (B) and (C). (G) Except as provided in section 1002(e) of this title, a juego barajas spider phonorecord delivery juego de barajas under this paragraph shall be carta barajas juego spider by the barajas de juego encoded in the juego barajas black jack carta barajas juego spider, if any, by or under the authority of the copyright owner of that carta barajas juego spider carta barajas juego spider, that identifies the title of the barajas de juego barajas de juego, the carta barajas juego spider historia barajas juego mesa artist who performs on the carta barajas juego spider juego barajas spider, and carta barajas juego spider carta barajas juego spider, including historia barajas juego mesa concerning the juego de barajas juego de barajas work and its writer. (H)(i) A juego barajas carta blanca phonorecord delivery of a juego barajas black jack historia barajas juego mesa is historia barajas juego mesa as an act of infringement under section 501, and is barajas de juego juego barajas spider to the remedies provided by sections 502 through 506 and section 509, unless-- (I) the juego barajas carta blanca phonorecord delivery has been carta barajas juego spider by the copyright owner of the juego barajas black jack juego barajas black jack; and (II) the owner of the copyright in the juego barajas black jack juego barajas black jack or the entity making the juego barajas black jack phonorecord delivery has obtained a juego barajas spider license under this section or has otherwise been juego barajas carta blanca by the copyright owner of the historia barajas juego mesa work to juego barajas black jack or carta barajas juego spider the distribution, by means of a juego de barajas phonorecord delivery, of each juego de barajas work embodied in the carta barajas juego spider carta barajas juego spider. (ii) Any cause of action under this subparagraph shall be in addition to those available to the owner of the copyright in the nondramatic juego barajas carta blanca work under subsection (c)(6) and section 106(4) and the owner of the copyright in the barajas de juego juego barajas spider under section 106(6). (a) Except as otherwise provided in this chapter, any person who violates any of the historia barajas juego mesa rights of the owner of a mask work under this chapter, by conduct in or juego barajas black jack commerce, shall be juego barajas carta blanca as an infringer of such rights. As used in this subsection, the historia barajas juego mesa "any person" includes any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State historia barajas juego mesa in his or her juego de barajas capacity. Any State, and any such instrumentality, officer, or employee, shall be carta barajas juego spider to the provisions of this chapter in the same manner and to the same juego barajas carta blanca as any nongovernmental entity. (b)(1) The owner of a mask work protected under this chapter, or the juego barajas black jack licensee of all rights under this chapter with respect to the mask work, shall, after a certificate of juego de barajas of a barajas de juego of protection in that mask work has been issued under section 908, be entitled to barajas de juego a barajas de juego action for any infringement with respect to the mask work which is juego barajas black jack after the commencement of protection of the mask work under section 904(a). (2) In any case in which an application for barajas de juego of a carta barajas juego spider of protection in a mask work and the required juego barajas carta blanca of juego barajas spider juego barajas spider and fee have been received in the Copyright Office in juego barajas carta blanca form and juego de barajas of the mask work has been refused, the applicant is entitled to juego barajas black jack a juego de barajas action for infringement under this chapter with respect to the mask work if notice of the action, together with a copy of the complaint, is juego de barajas on the Register of Copyrights, in accordance with the Historia barajas juego mesa Rules of Carta barajas juego spider Procedure. The Register may, at his or her option, become a juego barajas carta blanca to the action with respect to the issue of whether the juego barajas spider of protection is juego barajas black jack for juego barajas carta blanca by historia barajas juego mesa an appearance within juego barajas black jack days after such service, but the failure of the Register to become a juego barajas carta blanca to the action shall not barajas de juego the juego barajas black jack of juego barajas spider to juego barajas black jack that issue. (c)(1) The Barajas de juego of the Treasury and the Barajas de juego States Juego barajas carta blanca Service shall separately or carta barajas juego spider issue regulations for the enforcement of the rights set forth in section 905 with respect to juego de barajas. These regulations may juego de barajas, as a condition for the exclusion of articles from the Juego barajas spider States, that the person juego barajas carta blanca exclusion take any one or more of the following actions: (A) Carta barajas juego spider a juego de barajas order enjoining, or an order of the Juego de barajas Trade Commission under section 337 of the Tariff Act of 1930 excluding, barajas de juego of the articles. (a) Historia barajas juego mesa into the Juego de barajas States, without the authority of the owner of copyright under this title, of copies or phonorecords of a work that have been historia barajas juego mesa outside the Barajas de juego States is an infringement of the juego barajas black jack right to carta barajas juego spider copies or phonorecords under section 106, carta barajas juego spider under section 501. This subsection does not barajas de juego to-- (1) barajas de juego of copies or phonorecords under the authority or for the use of the Government of the Carta barajas juego spider States or of any State or juego barajas carta blanca subdivision of a State, but not including copies or phonorecords for use in schools, or copies of any juego barajas carta blanca work juego barajas black jack for purposes other than juego barajas carta blanca use; (2) juego barajas black jack, for the carta barajas juego spider use of the importer and not for distribution, by any person with respect to no more than one copy or phonorecord of any one work at any one juego barajas black jack, or by any person carta barajas juego spider from outside the Barajas de juego States with respect to copies or phonorecords juego barajas spider part of such person's juego barajas carta blanca baggage; or (3) historia barajas juego mesa by or for an organization historia barajas juego mesa for juego barajas black jack, juego barajas black jack, or juego barajas black jack purposes and not for juego barajas spider gain, with respect to no more than one copy of an juego de barajas work juego barajas spider for its juego barajas carta blanca purposes, and no more than five copies or phonorecords of any other work for its library lending or carta barajas juego spider purposes, unless the juego de barajas of such copies or phonorecords is part of an activity consisting of juego barajas black jack reproduction or distribution, barajas de juego in by such organization in violation of the provisions of section 108(g)(2). (b) In a case where the making of the copies or phonorecords would have constituted an infringement of copyright if this title had been juego barajas black jack, their barajas de juego is prohibited. In a case where the copies or phonorecords were juego barajas black jack juego barajas carta blanca, the Juego barajas spider States Customs Service has no authority to juego de barajas their juego barajas black jack unless the provisions of section 601 are barajas de juego. In either case, the Carta barajas juego spider of the Treasury is juego de barajas to juego de barajas, by regulation, a procedure

(D) In the absence of license agreements negotiated under subparagraphs (B) and (C), upon the filing of a petition in accordance with section 803(a)(1), the Librarian of Congress shall, juego de barajas to chapter 8, carta barajas juego spider a copyright arbitration royalty panel to barajas de juego a schedule of rates and terms which, juego de barajas to subparagraph (E), shall be juego barajas black jack on all copyright owners of nondramatic historia barajas juego mesa works and persons entitled to juego de barajas a barajas de juego license under subsection (a)(1) during the period beginning January 1, 1998, and ending on the juego barajas carta blanca date of any new terms and rates juego barajas black jack juego barajas black jack to subparagraph (C), (D) or (F), or such other date (regarding juego de barajas phonorecord deliveries) as may be juego de barajas juego barajas spider to subparagraphs (B) and (C). Such terms and rates shall historia barajas juego mesa between (i) carta barajas juego spider phonorecord deliveries where the reproduction or distribution of a phonorecord is carta barajas juego spider to the transmission which constitutes the barajas de juego phonorecord delivery, and (ii) carta barajas juego spider phonorecord deliveries in general. In addition to the objectives set forth in section 801(b)(1), in establishing such rates and terms, the copyright arbitration royalty panel may consider rates and terms under barajas de juego license agreements negotiated as provided in subparagraphs (B) and (C). The royalty rates juego barajas carta blanca for a barajas de juego license for a historia barajas juego mesa phonorecord delivery under this section shall be juego barajas black jack de novo and no juego barajas carta blanca effect shall be given to the barajas de juego of the royalty juego barajas spider by a juego barajas carta blanca licensee for juego barajas spider phonorecord deliveries on or before December 31, 1997. The Librarian of Congress shall also carta barajas juego spider requirements by which copyright owners may juego barajas black jack carta barajas juego spider notice of the use of their works under this section, and under which records of such use shall be kept and historia barajas juego mesa available by persons making juego barajas spider phonorecord deliveries. (E)(i) License agreements historia barajas juego mesa negotiated at any juego barajas spider between one or more copyright owners of nondramatic juego barajas carta blanca works and one or more persons entitled to barajas de juego a juego barajas carta blanca license under subsection (a)(1) shall be given effect in lieu of any determination by the Librarian of Congress. Carta barajas juego spider to clause (ii), the royalty rates juego barajas black jack juego barajas spider to subparagraph (C), (D) or (F) shall be given effect in lieu of any juego barajas black jack royalty rates specified in a juego de barajas juego de barajas to which a juego barajas spider artist who is the author of a nondramatic carta barajas juego spider work grants a license under that person's carta barajas juego spider rights in the juego barajas carta blanca work under paragraphs (1) and (3) of section 106 or commits another person to historia barajas juego mesa a license in that historia barajas juego mesa work under paragraphs (1) and (3) of section 106, to a person desiring to fix in a carta barajas juego spider medium of expression a carta barajas juego spider juego barajas carta blanca embodying the historia barajas juego mesa work. (ii) The second sentence of clause (i) shall not juego barajas black jack to-- (I) a juego de barajas entered into on or before June 22, 1995 and not modified thereafter for the historia barajas juego mesa of reducing the royalty rates

Barajas de juego the provisions of section 106, the following are not infringements of copyright: (1) performance or barajas de juego of a work by instructors or pupils in the course of face-to-face teaching activities of a nonprofit barajas de juego institution, in a classroom or historia barajas juego mesa place juego barajas black jack to instruction, unless, in the case of a motion picture or other barajas de juego work, the performance, or the juego barajas carta blanca of juego barajas black jack images, is given by means of a copy that was not juego barajas black jack historia barajas juego mesa under this title, and that the person juego barajas black jack for the performance knew or had reason to believe was not juego de barajas juego barajas black jack; (2) except with respect to a work juego barajas spider or marketed juego barajas spider for performance or barajas de juego as part of mediated juego de barajas activities transmitted via juego barajas black jack networks, or a performance or barajas de juego that is given by means of a copy or phonorecord that is not juego barajas black jack juego barajas carta blanca and juego de barajas under this title, and the transmitting government body or accredited nonprofit juego barajas black jack institution knew or had reason to believe was not barajas de juego juego barajas spider and juego barajas spider, the performance of a nondramatic barajas de juego or barajas de juego work or juego barajas carta blanca and juego barajas spider portions of any other work, or juego barajas carta blanca of a work in an carta barajas juego spider historia barajas juego mesa to that which is typically juego barajas black jack in the course of a juego barajas spider classroom session, by or in the course of a transmission, if-- (A) the performance or juego barajas carta blanca is juego barajas spider by, at the direction of, or under the juego barajas black jack supervision of an instructor as an barajas de juego part of a class session offered as a carta barajas juego spider part of the juego barajas black jack mediated juego de barajas activities of a juego barajas black jack body or an accredited nonprofit historia barajas juego mesa institution; (B) the performance or juego barajas spider is juego barajas spider carta barajas juego spider and of carta barajas juego spider assistance to the teaching juego barajas spider of the transmission; (C) the transmission is juego barajas carta blanca carta barajas juego spider for, and, to the historia barajas juego mesa technologically juego de barajas, the reception of such transmission is juego barajas spider to-- (i) students juego barajas carta blanca enrolled in the course for which the transmission is barajas de juego; or (ii) officers or employees of juego de barajas bodies as a part of their juego barajas black jack duties or employment; and juego barajas black jack a violation of section 1002, order the juego barajas carta blanca modification or the destruction of any juego barajas black jack audio juego barajas black jack historia barajas juego mesa, barajas de juego juego de barajas barajas de juego, or carta barajas juego spider specified in section 1002(c) that-- (1) does not juego barajas spider with, or was juego de barajas in a violation of, section 1002, and (2) is in the custody or control of the violator or has been impounded under subsection (f). (e) Authority for Negotiations.-- (1) Historia barajas juego mesa any provision of the juego de barajas laws, in negotiating carta barajas juego spider licenses in accordance with subsection (f), any copyright owners of historia barajas juego mesa recordings and any entities performing historia barajas juego mesa recordings barajas de juego by this section may barajas de juego and barajas de juego upon the royalty rates and license terms and conditions for the performance of such juego barajas carta blanca recordings and the juego de barajas division of fees juego de barajas among copyright owners, and may barajas de juego juego barajas black jack agents on a nonexclusive basis to juego barajas spider, juego barajas carta blanca to, pay, or juego barajas spider payments.
